🚨FEDERAL COURT RULING ON EMERGENCIES ACT 🚨 During 2021, a group of Canadian truck drivers and their supporters rallied in Ottawa, Ontario, Canada’s capital.

They closed down streets, honked their horns and carried signs that called for an end to the COVID-19 vaccine mandates ordered by the federal government.

In response, the Canadian government, led by Prime Minister Justin Trudeau, invoked the Emergencies Act for the first time since it was created in 1988. This gave it the power to shut down the protests.

On Jan. 23, Federal Court Justice Richard Mosley ruled that Trudeau’s decision to use the act was “unreasonable” and “unintelligible”.

The Honourable Justice said that it violated one of the rights in the Canadian Charter of Rights and Freedoms, which allows groups of people to gather and protest.

This goes against a previous ruling from Feb. 17, 2023, where a judge decided that Trudeau’s use of the Emergencies Act was “justified.”

While it is true that all the other long-term details of the separation and divorce may take time to get worked out, children still need a regular routine. They have a right to be clothed, housed and fed.

💡 TIP 💡when separating, try not to let matters escalate and maintain child support payments. You do not have to go to court to figure out child support. Instead, you can reach agreement on your or with the assistance of a lawyer. Do not stop making regular payments to spite your partner or spouse - this behaviour is frowned upon by courts.

Another criminal law victory for Fember Attorneys. Today, judgment was handed down in a bail appeal matter in which we represent an accused charged with a schedule 5 offence. This was an appeal against the decision of a magistrate to refuse to release our client on bail, notwithstanding that he met the onus of proving that his release will not erode the interests of justice. Our firm, on behalf of our client, approached the High Court on Appeal. The High Court overturned the decision of the magistrate on the basis that the magistrate misdirected himself and erred in finding that the seriousness of the offence (schedule 5) alone should operate to justify our client’s incarceration until the conclusion of his trial.

When deciding whether to not to grant bail, a court is obliged to attach sufficient weight to the constitutional presumption of innocence, and other factors outlined in section 60 (11) of the Criminal Procedure Act.

The purpose of bail is to ensure that the offender attends his trial. Bail should not be used as punishment and every court that adjudicates a bail application needs to be mindful of the constitutional considerations and competing rights.

We are extremely proud of this victory, especially owing to the fact that our client no longer has to endure the horrendous conditions in prison while awaiting his trial, which could take years to conclude.

UNMARRIED PARENTS AND THE FAMILY ADVOCATE

Did you know that currently, South African legislation only allows married parents to seek the assistance of the family advocate in matters involving parental rights and responsibilities?

If you are an unmarried parent, you need a court order which instructs the Family Advocate to become involved.

A party who is divorcing or divorced can complete an annexure “B” form (Mediation in Certain Divorce Matters Act) to obtain an investigation by the Family Advocate.

In the recent case of ST v BN and Minister of Justice, the arbitrary distinction occasioned by policy and/or the Act was declared to be inconsistent with the Constitution and with the Children’s Act 38 of 2005.

This constitutional issue was mero motu raised by the High Court. A reading in is provided pending decision of the Constitutional Court.

🚨 RAPE JUDGMENT (TRIGGER WARNING⚠️) 🚨

Last week, a rape conviction was overturned in the Eastern Cape High Court. Many have angrily expressed their outrage at the judgment and completely misinterpreted what it means.

South Africa has disproportionately low convictions for rape. This is not to be blamed on the judiciary, but the fact that our sexual offence legislation is outdated.

Acting Judge Tembeka Ngcukaitobi overturned the rape conviction of paramedic Loyiso Coko, who had argued that he believed that the complainant had consented to intercourse.

Some people have interpreted the judge's decision as suggesting that the complainant woman had, by agreeing to oral sex, also tacitly consented to penetrative sex. This is NOT the case and there has been a wide misunderstanding of the judgment. The ruling did NOT in fact say that.

The existing legislation itself left Ngcukaitobi AJ very little room to rule in favour of the complainant. What needs to be understood is that in South African law, it is a defence to a charge of rape or other sexual offence involving consent, that the defendant subjectively believed the person was consenting. If the State is unable to disprove that you subjectively believed that then you are entitled to be acquitted.

It is outrageous that our laws do not provide enough protection to the women in our society and that the threshold is so high.

There are several other technical issues which we can identify in the judgment, which also generates an important debate about whether the court correctly approached the concept of consent in sexual offence cases.

Whilst the court could have come to a different conclusion, if it had considered the conduct of the proceedings in the lower court, the law was applied correctly.

This case does NOT say that foreplay/ consent to foreplay is tacit consent for penetration.

The definition of rape is that there must have been penetration that was unlawful and intentional in the absence of consent.

🚨 WHAT IS “CONSERVATORSHIP?”🚨 Britney Spears’ conservatorship has undoubtedly been the subject of widespread discussion within the American justice system, more specifically the right to emancipate yourself from conservatorship. Before you “hit me baby one more time”, there are a few things to consider.

In South Africa, the process is known as curatorship and involves a High Court Application, the consequences of which are as follows:
That the Patient (being the subject of the application – ‘Britney Spears’) is:

1. Declared to be of unsound mind;
2. Incapable of managing his/her own affairs; and
3. A curator bonis (curator) is appointed to the Patient’s estate to administer his/her property.

An important point to note is that it is not impossible to rescind an order of curatorship and you will not have to broadcast your plea for help on social media as Brittany unfortunately had to do. Please ensure that you take proper legal advice before you proceed with an application for curatorship as there are certain consequences that follow from such an order including, but not limited to, annual reporting requirements to the Master of the High Court which includes audited financial statements and concise record keeping on the Patient’s health status.

Common conditions which justify the appointment of a curator are mental illness, physical illness or a display of behaviour which is not consistent with that of a person who is of sound mind.

Conversely, should you wish to emancipate yourself or another from a curatorship order, it is also encouraged that you to take proper legal advice before you proceed with a rescission application in the High Court.

🚨 CAN YOUR EMPLOYER IMPLEMENT A MANDATORY VACCINATION POLICY? 🚨

The debates around the Constitutionality of mandatory vaccinations is growing and is heated, but the answer for the time being is yes- employers can implement vaccine mandates.

Although employers can insist on mandatory COVID-19 jabs before returning to the workplace, employees can still refuse on reasonable grounds.

It is important to note that although the Occupational Health and Safety Measures in Certain Workplaces Regulations have been revised in light of the vaccine rollout, several legal experts have encouraged employers to remain steadfast in promoting mutual respect and understanding when considering the implementation of a vaccine mandate as we are all entitled to bodily integrity and freedom of belief.

The Human Rights Commission has recently confirmed that it may be permissible to implement a vaccine mandate should a health and safety committee confirm that vaccines will contribute to the company’s operational requirements. Further, that it may also be permissible to retrench an employee due to operational requirements in that they may not be able to isolate an employee or allow an employee to work from home.

We are yet to see any Applications being issued in our Courts on the matter, but Fember Attorneys is up for the challenge! We are keeping a close eye on local and international jurisprudence and are gearing up for the debate of the century.

🚨 SUMMARY JUDGMENT DEFENCES 🚨 lockdown as a supervening impossibility in commercial lease agreements (lockdown)- in this case, La Kandyan Trading entered into a lease with applicants to lease premises in Nelson Mandela Square so that they could operate the restaurant, Mayur Indian Cuisine. The restaurant and Ms Nizar, who signed as surety, failed to make payments for an acknowledgment of debt for R953,972 and also for the arrears of over R2 million. Applicants brought a summary judgment application under the amended Rule 32.
in this case De Wet AJ discusses the defences raised of lis pendens; that respondents were denied access to the premises during the Covid lockdown, which constituted an intervening impossibility; that the deponent to the affidavit in support of the summary judgment did not have the necessary knowledge; and that the respondents had lost possession of their premises when they were taken over by business partners.
Summary judgment is granted, though defendants are granted leave to defend for rental for two months.
